The availability of a domain name is determined by whether it has already been registered as a website address on the internet. On the other hand, the availability of a business name is governed by business registration laws and depends on whether another company has already registered that name in the relevant jurisdiction. Similarly, the availability of a business name doesn’t guarantee that the corresponding domain name is free. The domain name could have been taken by someone else for their website, even if they don’t own the business name. Therefore, when setting up a new business or website, it’s important to check both the business name registry and the domain name registry to ensure your chosen name is available in both places.

Google Search – While a Google search can provide some insight into the availability of a business name, it’s important to note that this method may not yield definitive results. This is primarily because a Google search only displays information about businesses that maintain an online presence. However, many business entities, particularly those used for specific purposes such as holding companies, may not have an online presence. These businesses operate discreetly, often without a website or social media accounts, making them invisible to a standard online search. Therefore, a lack of search results does not necessarily mean that a business name is available for use.

NUANS Search – To truly determine the availability of a business name, conducting a NUANS Search is the most effective and reliable method. This search is not just a simple online query, but a comprehensive exploration of a government-maintained database that includes all registered entities within Canada. This database is meticulously updated and managed, ensuring the most accurate and up-to-date information. Therefore, a NUANS Search stands as the best and only definitive way to confirm whether a desired business name is available for use in Canada.

A NUANS Report, a document that compiles similar existing corporate, business, and trademark names to your proposed business name, is a crucial tool for determining name availability. This report is a requirement for business registration or incorporation by the Federal and most provincial governments in Canada, including Ontario.

Keep in mind that a NUANS report has a validity period of 90 days. If this period expires, a new NUANS report must be ordered for use in registration or incorporation. Fully understanding the report is essential before moving forward with your business registration or incorporation.
